PRESERVATION: PERSONAL AND CORPORATE ASSET PRESERVATION

Asset Preservation and Estate Planning Legal Services
During the first year of the program, CAPS+ physicians receive unlimited asset protection and estate planning legal services from experienced attorneys. These legal services include the formation of an unlimited number of asset protection and estate planning entities, including wills, advanced directives, irrevocable trusts, revocable trusts, FLPs, LLCs, CRTs, etc.

In each successive year of the program, your plan will be analyzed to ensure that it is consistent with recent case law and your changing personal and financial goals. Any one additional asset protection or estate planning entity that is needed to keep your plan up to date will also be implemented at no additional charge.

For those physicians under the age of 40 and within the first five years of practice, Physicians Advantage offers a Young Physicians CAPS+ program, which contains all of the components described below but is slightly modified with regard to the domestic legal services component. For Young Physicians, our team of attorneys will create and fund any two asset protection or estate planning entities, prepare wills and/or revocable trusts, prepare advanced directives and provide assistance with negotiating contracts (including employment agreements and office leases).

Accounts-Receivable Leveraging And Protection
Through the CAPS+ program, PA Financial Advisors will analyze your practice’s accounts receivable and designs a customized strategy to both leverage and protect this critical asset. These strategies can also be integrated with other advanced planning strategies, such as buy-sell agreements or captive insurance structures, depending upon the individual needs of the practice.

Pension/Profit-Sharing Compliance And Design
For CAPS+ physicians, RSM McGladrey, the fifth largest accounting firm in the world, performs an annual pension/profit sharing compliance analysis. This analysis ensures that your plan is compliant and thus exempt from creditors. RSM will also analyze the design and fee structure of your plan to ensure it is operating in the most efficient manner possible.

Wealth Management
PA Financial Advisors will analyze your investments and recommend strategies to maximize wealth, putting an emphasis on proper asset allocation to minimize risks and taxes while increasing returns.

Tax and Estate Planning
PA Financial Advisors will examine your tax situation and estate plan and provides solutions to make sure your wealth is subject to as little taxation as possible while securing the highest possible transfer of wealth to your beneficiaries.

Practice Succession Planning
PA Financial Advisors will implement plans to make sure your practice is passed on seamlessly to your successor upon your retirement or in the event of the death or disability of yourself or your partner(s).successor upon your retirement or in the event of the death or disability of yourself or your partner(s).

Retirement Planning
PA Financial Advisors will examine your retirement plan and make recommendations for new opportunities, improved asset allocations and retirement-funding strategies for every stage of your career.

Physicians need insurance protection for both their professional and private lives. PA Financial Advisors will analyze your current coverages and make suggestions to reduce risks, enhance benefits and trim costs.

MEDICAL MALPRACTICE PLANNING AND DEFENSE

Medical Malpractice Defense Services
This component of CAPS+ is directed by the attorneys at Rissman, Barrett, Hurt, Donahue & McLain, P.A., each of which have experience defending physicians throughout the state of Florida. They have consulted on thousands of medical malpractice cases and provide a unique perspective to physicians facing potential litigation. When a CAPS+ physician receives a notice of intent, Rissman Barrett is immediately available to help the physician avoid commonly made mistakes. This defense component also provides the opportunity to deter the plaintiff’s attorney at the inception of the case by alerting the attorney that the physician has engaged in proactive asset protection and will be vigorously defended on the merits. Rissman Barrett will also provide an assessment as to whether a standard of care breach occurred and if so, the level of financial exposure faced by the physician based on Florida law and Rissman Barrett’s familiarity with past outcomes in similar cases.

Medical Malpractice Insurance / Risk-Management Consulting
An insurance professional will conduct an analysis of your “exposure” and a review of your current medical malpractice insurance coverage. Following that analysis, we examine your alternatives and offer suggestions.

Medical Malpractice Defense Network
For physicians practicing with medical malpractice insurance, Rissman, Barrett, Hurt, Donahue & McLain, P.A., will assist you should you receive a Notice of Intent and will ensure that you contact your carrier immediately to take advantage of this representation. But the scenario is different for those without insurance or if your carrier advises you to obtain separate counsel because of a possible claim in excess of your coverage. In these situations, Rissman Barrett will help you choose a well-qualified defense attorney at substantially reduced rates through our network of attorneys.
